Apparently, the 9 school officials have agreed among themselves on a deal that will break up our school. Each side will get 1/2 of school assets after legal fees are subtracted. All told, HXNY will be severely weakened with a different name.
If you feel that a decision of this magnitude should be put through a vote by all members, I suggest you let our school officials and Justice Joan Lefkowitz know before she rules next Tuesday (7/24) at 9:30 am at the Westchester Court House, 111 Martin Luther King Blvd.,White Plains, NY 10601
I have already submitted the "3 principles" proposal to Justice Leftkowize but it says nothing of the break-up.
In addition, even if one agrees with breaking up the school, one should object to paying those who initiate lawsuits. It sets a dangerous precedent and commits a moral hazard.
Principles 1) Principal-elect Yang Dai and PC Chair-elect Liang Cao will be responsible for 2012-2013 operations. Current Admin/PC teams of 2011-2012 are responsible to complete all transitions consistent with traditional practices of HXNY, including but not limited to handing over the registration system before 7/15. This will allow the new administration to complete student registration; retain and hire teachers; order textbooks and sign classroom contracts with Westchester Community College in time for 9/2012 opening.
2) All plaintiffs and defendants immediately drop all lawsuits and countersuits to prevent further financial damages to our school.
3) All plaintiffs and defendants step down from their respective positions immediately and will not assume any HXNY leadership positions for 2 years. A new Board will be voted in by all members before October 30.
First, why should HXNY name be changed? Second, why should both sides get legal fee reimbursed? Third, who the hell are you 9 silly heads to make the decision for all the members?
The only legitimate party to make this huge dicision is the members altogether! Let the court know the voice!
The new admin has this perfect opportunity to shine! Prove yourself! Stand up to represent the school and fight! You will have a lot of support for sure!

PETITION IN SUPPORT OF SETTLEMENT OF LITIGATION
We, the undersigned members of Huaxia Chinese School, New York, fully support the settlement of the lawsuit pending in New York Supreme Court, Westchester County (Hu v. Zhu, No. 58072/2012). We do not represent any one faction of the community. Rather, we represent the full spectrum of the School’s membership, including supporters of Plaintiffs Dapeng Hu and Yawen Liu and Defendants Li Zhu, Gutuan Zheng, Lida He and Sue Ying Huang.
We recognize that two groups of actively involved School leaders and many of the members have different and irreconcilable views about, among other things, the educational direction of the School. We believe that the Settlement will serve the best interests of the School, its membership, and the Chinese-American community by permitting the peaceful co-existence of two separate schools in the future. This will bring an end to the recent and repeated disputes within the School, and will allow each member to join the school that best meets his or her educational goals.
We are aware that the settlement involves the partial indemnification of legal fees and costs, up to a total of $45,000 for Plaintiffs and up to a total of $45,000 for Defendants. We believe this limited indemnification, as part of the settlement, is in the best interests of the School and its members.
It is not rumor. Hu said in the all parents meeting. Li Shengjing claimed that he filled the form but he never told Alan Wang. The fact was no one filled the form in History so it is Hu Dapeng's fault because IRS came to us when he is the Principal.
Hu spent 200,000 dollars extra to run the school this year including deficit, attorney fee and IRS lawsuit.
There is only $40,000 left. He wants to split the school and take $20,000 with him. Cheap bastard. Can you imagine he is a MD at BlackRock? Rumor said he makes $1 million a year.
He sure knows how to waste money, $240,000 gone within one year under his watch! While he never donate one penney for HXNY!

有人害怕官司打得没完没了。我的建议要求尽快要法官判决：1)家长上交独立的请愿书；2）七董事和胡/刘上交他们自己搞出的“协议”。无论法庭的结果如何，官司都不会在打下去了。谁要不服，打官司的钱自己出好了。

ReplyDelete非盈利机构就不应该打官司。胡大鹏的律师费我们家长不付，胡大鹏是挑事的。朱立是被迫应战，他的律师费可以酌情报销。如果他们都不撤诉，那就滚一边去闹吧，费用自理，因为他们双方都不代表华夏多数家长的利益。

中文学校不光有下流下作之人，也有听风就是雨的智障人士。有个网名为“马后炮”的人，看到网上信口开河的东西，马上追到我的邮箱里声讨了我一番，说我不该写“排队队，吃果果”的歪诗。
ReplyDelete我来到这里，才发现原来谣言来自这个匿名帖：“不是，马后炮没这水平。是李晓京写的。”“马后炮”信以为真了，以此来指责我，搞得我一头雾水。
“马后炮”，你究竟是什么智商啊？以后，我不再回应匿名人士。
写这首匿名诗的家长，蛮有点才的，想来是个文学中年，喜爱舞文弄墨。不过，这首歌谣的原始版本不是“排队队，吃果果”，而是“排排坐，分果果，你一个，我一个，冬冬不在留一个。”
歌谣的关键字在“分”。
现在学校“上层”在闹分校，分校产....比如已退休的G大佬，想来会给他在董事会留一席位。

ReplyDelete学校都闹一年了，俺只做壁上观，只要不影响俺娃上学就行。下学年的校长也选出来了，俺就放心度假去了。谁知回来后，俺大吃一惊：“华夏中文学校”眼看要没了！这个建校16年的公益学校，正像冰棍一样，要被一小撮精英们给“化”没了！咦？俺不是会员吗，如此大的事情，怎么事先一点征兆都没有啊？
根据路边社报道，胡司令挑头打起的官司，几乎会把俺们的校产消耗殆尽。家长们要为精英的官司支付9万块钱，据说还有一场官司要花去6万块钱！WHAT？大人们打官司，厚颜花去15万的律师费，仅给我们的孩子剩下4万块钱办教育。分校后，每个学校仅得两万块。这么什么样的joke？惹是生非的精英们不但不受惩罚，家长还为他们的行为埋单。这居然发生在光天化日之下！

说得是有道理, 不settle这钱花得更多. 可是学校也剩下没几万了, 其实官司再打下去是对要学校买单的人不利. 更重要的是我们广大家长们不能用这样软弱的方式就被强暴了, 至少要力争大多数家长的权利. 不能付9万如此之巨, 还有九人承诺二年里不可以在分开的两学校当任何职务等等. 这样让别有用心的人不轻易告人, 也没机会达到不可告人的目的. 否则这个坏头开了, 学校永无宁日.

说到底，还是一个钱的问题：

双方是不是自己也应该出一些，学校付9万，是不是太黑心了？比如说每一方报销2.5万，中文学校出5万，剩下四万给学生用，这样他们九个人还可说是“为学校，为学生”。
要是把学校的钱全用完了，用在自己身上，这是为学校好吗？！
如果学校有20万，学校付9万律师费，剩下还有11万，每个分校分5.5万。为什么有人说只有两万？这算术是如何做的？

Principles
1) Principal-elect Yang Dai and PC Chair-elect Liang Cao will be responsible for 2012-2013 operations. Current Admin/PC teams of 2011-2012 are responsible to complete all transitions consistent with traditional practices of HXNY, including but not limited to handing over the registration system before 7/15. This will allow the new administration to complete student registration; retain and hire teachers; order textbooks and sign classroom contracts with Westchester Community College in time for 9/2012 opening.
2) All plaintiffs and defendants immediately drop all lawsuits and countersuits to prevent further financial damages to our school.
3) All plaintiffs and defendants step down from their respective positions immediately and will not assume any HXNY leadership positions for 2 years. A new Board will be voted in by all members before October 30.

你有什么证据说不是华夏的人签了名？ 你就是一颗老鼠屎。
去看四董告人的文件。程立洁不敢在法官面前说谎，说了有签名的人不是HXNY的人。
Delete程立洁是一个心胸坦荡的家长。从一开始，她就严格把征集来的300多“要求胡/刘撤诉”的签名分成两部分：
Delete一、280多（大概这个数据）是现有会员；
二、20-30个，是老会员，其中包括1）在华夏10年以上、孩子新近从学校毕业的家长，因为这些人为华夏的建设出过力量，他们的声音也希望法官听到；2）还有几个是老师。虽然她们不是会员，但是在学校教书多年，领取低薪，华夏的成就也有老师的奉献。
那些妄图毁坏程立洁名誉的人，实在是猥琐小人。你们匿名骂她，不过是她揭露了你们，反对给挑起官司的恶棍报销律师费。她是在捍卫家长利益，这样的人值得大家尊重！
听说肇事的胡司令也准备去度假了，飞机票都买好了。胡司令得到了想得到的东西，听说他逢人都是一副笑嘻嘻的模样。但是，他留下了很多犯愁的家长..

真不知道胡司令示人人还是鬼。作为校长，学校被搞成这样，他还可以“逢人都是一副笑嘻嘻的模样”？可以度假？无语。难怪学校会被搞成这样
胡司令打官司为的是什么？为的是争“自动进董事会”；

胡司令最得意的是什么？
今年，他过了一年校长瘾，搞得民怨沸腾；
明年他的新校又开张了，不用打官司自动就做了董事长。
估计胡的学校是私人学校，因为非盈利学校的注册繁琐，至少需要提前半年做注册准备。所以在他的学校里，家长是马仔，老师是雇员，整个学校绝对是他一手遮天。
如果胡的学校不是非盈利学校，他是无法从华夏拿到一分钱的。非盈利机构的钱只能转给或捐给另一个非盈利机构。
Delete最大的输家是郑奇和戴扬。反对分校的是郑奇和戴扬的班子。

ReplyDelete学校都闹一年了，俺只做壁上观，只要不影响俺娃上学就行。下学年的校长也选出来了，俺就放心度假去了。谁知回来后，俺大吃一惊：“华夏中文学校”眼看要没了！这个建校16年的公益学校，正像冰棍一样，要被一小撮精英们给“化”没了！咦？俺不是会员吗，如此大的事情，怎么事先一点征兆都没有啊？
根据路边社报道，胡司令挑头打起的官司，几乎会把俺们的校产消耗殆尽。家长们要为精英的官司支付9万块钱，据说还有一场官司要花去6万块钱！WHAT？大人们打官司，厚颜花去15万的律师费，仅给我们的孩子剩下4万块钱办教育。分校后，每个学校仅得两万块。这么什么样的joke？惹是生非的精英们不但不受惩罚，家长还为他们的行为埋单。这居然发生在光天化日之下！
欺人太甚！欺人太甚！！你们真觉得中文学校无人了吗？几百名家长会由着你们撒欢儿？
听说一些蒙在鼓里的家长，终于醒过味儿来，要求去法庭要说法。于是精英们慌了，想到“民意”了，赶紧组织了啦啦队"民意党"，,掩饰他们践踏会员知情权的恶行。
今天上午他们炮制了《“支持分校”的请愿倡议》。有没有搞错啊？你们密谈“分校”的时候，瞒着大家。等到生米做成熟饭，等在律师协议书上签字了，你们才假惺惺来问询“民意”。校章规定：“分校必须3/4的会员同意，才可以进行。”可是，嚣张的精英们，选择雇请律师来分校，偷偷摸摸要跳过全校会员。听说他们的“分赃”协议已经在律师信上签好了，就等下周二法官判决了。这个分校方案，不是建立在民意基础上，不是以公开透明的程序形成的。
精英“分校”的密谈已经进行几周了，其细节家长们都不清楚。请知情的大侠们把他们的“分赃”内容贴在网上。俺叩谢了！

Apparently, the 9 school officials have agreed among themselves on a deal that will break up our school. Each side will get 1/2 of school assets after legal fees are subtracted. All told, HXNY will be severely weakened with a different name.
If you feel that a decision of this magnitude should be put through a vote by all members, I suggest you let our school officials and Justice Joan Lefkowitz know before she rules next Tuesday (7/24) at 9:30 am at the Westchester Court House, 111 Martin Luther King Blvd.,White Plains, NY 10601
I have already submitted the "3 principles" proposal to Justice Leftkowize but it says nothing of the break-up.
In addition, even if one agrees with breaking up the school, one should object to paying those who initiate lawsuits. It sets a dangerous precedent and commits a moral hazard.
