一阵欢呼声入耳，原来特投会公布新校章以２５９票赞成，９７票反对通过了。
新校章提议现任全体校领导成员（董事会，校委会，家长会）自动退出，不参加下届任何选举职位。这个俺是赞成的，说不准那天俺想不到的就混成干部了。
但是俺对投票的程序很有疑问，暂且不提两个投票点如何计票等问题。投票定于４月１５日，当天却没开票而是裹着票箱抱家去了。第二天４月１６日特投会通告新校章现场投票完成，所有选票已封存；邮寄选票截止日期是4月29日中午12点；投票结果将在4月29日计票后公布。
这么个重大事件，特投会本应事先计划投票程序, 临场随机应变不免太儿戏了吧。特投会找到New York Absentee Voter Guide作为拖延的依据，让人感觉有事后敷衍的嫌疑。如果事先说明投票规程，即使没有这个Guide，大家也不至于牢骚满腹。况且特投会完全应该在4月15日公布当天票数，这样特投会和家长对有多少后来增加的缺席票都能心中有数。
本来剥夺选举权就影响人自身利益和工作积极性，好在家长会举办的公投以不到２／３赞成票４月１５日否决了新校章。现在你特投会宣布新校章通过，这不是向校委会宣战吗？

ReplyDelete朱立用来邮寄的名单是去年四家长寄7.17弹劾五董的名单，包括晓笛汪元学校一百来人，不包括今年新加入HXNY的K班家长。很多马力平班的家长根本没接到选票。一百多票Yes是从汪元小笛的学校寄来的。实际只收到HXNY会员的YES不到159， 跟家长会的117差不太多。票箱是放在朱立家的，取信的也是朱立。
ReplyDeleteAll Votes are checked against parents from the new 2011-2012 school directory. There are parents along with your representative Mingjiang Gao there for the whole process. It was checked and checked and checked again and agian. There is NOT a single vote from Xiaodi's school. Please stop spreading rumors. I hear spreading rumors is the talent of this school administration!

4/29晚上SVC公布投票结果, 5/1早上ADMIN发表公告, 呵呵反应迅速强烈:

在法制的轨道上让华夏健康地发展正常的运作，是每个华夏人的愿望。修改校章，就是要为华夏制定更全面的法律，让学校更好地在法律的框架下依法解决问题。但是我们很遗憾地看到在校章修改和投票的过程中，董事会主席知法犯法，公然违背bylaw 中“投票必须由家长会任命的投票委员会举行”的规定，把个人意愿伪装成董事会决议，私自成立所谓的“特别投票委员会”，组织非法投票。并且在选票制做上误导欺骗群众，发票投票过程漏洞百出。严重干扰学校的正常运作并在群众中造成极大混乱。
家长会、校委会尽最大善意，苦心规劝相关人士不要罔顾法律规定，并尽可能通过协商解决争端（参看附件家长会要求“特别选举委员会”终止非法行动的信）。然而个别董事继续我行我素，一意孤行，悍然宣布其不合法的投票结果，并企图造成既定事实，进一步把学校引入混乱。
为了保证学校的稳定和正常运作，维护学生、家长和学校的长远利益，为了华夏在法制的轨道上健康发展，家长会、校委会迫不得已，只好诉求于法律援助，重申无论是谁、无论何时，都不能凌驾于法律之上。根据校章和法律，4/15 日家长会主持的校章投票结果是唯一合法的结果; 个别董事的投票行为非法，投票结果无效。请查看附件律师的法律意见报告。
我们尊重华夏成员对校章表达不同意见的权利，大家对校章或许观点各异，但我们都全力维护一个共同的原则，那就是校章的权威性不容践踏。如果我们今天对某些人肆意违反校章纵容姑息，那么明天，无论我们施行什么样的校章，也都无法阻止某些人为所欲为，华夏就将永无宁日。我们再次呼吁终止非法行为，协商解决争端。如果有人一意孤行继续知法犯法，学校会采取进一步的法律行动来结束混乱，坚决保证学校的正常运作。

Dear Members of the Board of Directors:
As the Chair of HXNY Parent Counsel, I have requested and obtained advice of counsel with respect to the School’s By-Laws and, particularly, the provisions concerning amendments to the school's By-Laws and the role of the Members and the Parent Counsel in that amendment process. As you are aware, at its meeting of March 25, 2012, the Board of Directors set a date of April 15, 2012 to conduct a vote on a proposed amendment (the “amendment”) to the school’s By-Laws. At that meeting, the Board expressly acknowledged that the Parent Council would be responsible for executing the voting process by the Members, which is consistent with the school’s By-Laws.
On the day that voting for the Amendment was conducted, the Parent Council collected ballots from Members as it was authorized to due under the By-Laws and pursuant to the March 25, 2012 resolution of the Board of Directors. However, certain members of the Board of Directors (the “Dissenting Directors”) also collected ballots from Members in a separate voting process on the Voting Day, and has encouraged Members to continue to vote through mail-in ballots, a process that was not authorized by the Parent Council, the By-Laws or the Board itself. It is to our regret to see the Dissenting Directors insisted to proceed with Sunday’s ballot counting which started on unfounded legal ground and has been tarnished with all the manipulative practices. No matter what the result is, the void nature of it will never change. Given the serious confrontation which could drag the school into further division, and after exhausting all of our negotiating efforts, it became necessary to seek legal advice in order to deter the Dissenting Directors from making more chaos to the school.
Attached is the advice of counsel to the Parent Council and the Principle of the School stating that the actions of the Dissenting Directors was not authorized by the Board of Directors or the By-Laws, and that the result of the ballots collected by the Dissenting Directors should be considered null and void. In the event the Board and/or the Dissenting Directors seek to uphold the unauthorized actions of the Dissenting Directors, the School will give serious consideration to taking legal action to obtain a fair judgment. The Dissenting Directors should take full responsibilities for the chaos they've brought to the school.
Hereby we request once again the Dissenting Directors to immediately halt the illegal voting process. We suggest all board, school admin and Parent Council members to discuss the situation in order to reach a consensus. We are all under the obligation of resolving the crisis instead of taking any unilateral action to make it worse.

特投会完全违背了纽约州法关于邮寄投票的规定.
