It's too early to think about the fall. I usually like this blog owner's writings, but this posting wasn't the best. It started with a few interesting passages, then as if he's got a little too much to drink himself, it ended without much of a point. The inferences are not quite connected. Still it's a good try. Maybe next time drink a lot more while writing and let us know what you really think.
Try it. How many signature did you get? Still 12. By now, you should know how many supporters you have.
Even people like Hang Gao, Ergang Shi, Jin Lin, Zuojing Cao, Feng Lou, Zhiqiang Guan, Qian Lou, Lin Shi, Jiahui Ge, Michael Wu will not sign your petition for removing Zhu Li. You know why, though they support you to certain aspect, they are still decent people and know you did many wrong things and don't want to put down their names with your low lifes.
When people exercise their right to sue for the benefit of the school, this woman says it's 国民党白色恐怖. When the board members did the opposite of what's in the bylaws after legal opinions pointed out they're opposites, this woman says it's good faith. My view - only one v - is that this woman hated the lawsuit because it destroyed her chance of getting elected into the board herself. Power hungry four board members' activities are to make people follow their directions and to tell people who's in charge. That means the illegal activities are for their own benefit. The benefit doesn't have to be tangible. The distorted facts, misunderstood law and ill conceived logic aren't even worth my time to dispute. How could the movie filled brain begin to understand?
Everyone has a brain, so your assertion is medically implausible. The question is what's inside of your brain. I say your brain is full of stupid movies and hatred that blurred your simple moral. A judgment from the court will certainly knock you all into semi consciousness and then you can begin to wonder, maybe.
Dear friends, Everyone know the school is pretty chaotic. The school belongs to all members, if nobody cares about the school, and we can only accept whatever is being offered, which may not be to the best interest of parents. I don't know too much about the history and not interested to know either. I am sure there is a lot baggage there. However there are two things bother me the most in the past few months:
The school already have a voting committee for Bylaw and the whole process is fairly transparent. Without going through any normal legal procedure, either you have to find the current voting committee is illegal and cancel it before you can set up another one, the Board Chairman set up a voting committee themselves and without any supervision. If anyone can do this in school, how chaotic it will be. ByLaw means " By the Law". Everyone has to follow it before the new bylaw is passed. ByLaw states 5 board members need to be present to call a Board meeting. So far there have not been anytime we have more than 4 members for the board meeting and the board chairman made a lot of statement claiming that is Board's decision. As the Board chairman, he supposes to have the best knowledge about bylaw and he is the one violates it the most.
Below is an email from a parent in my son's class. It propose a temporal solution for now. IV. Parent Council Chair’s response to “School Leader Election: Hosted by the Board on Sunday, 06/19”
Dear all members,
This is to respond to the board's Request for election on June 19, 2011.
First I didn't postpone the meeting on June 12. It was the board that delayed the meeting and due to time limit, it was impossible to finish the agenda. It was clear and nobody should try to confuse and mislead members.
It is clear in the bylaws that a meeting of member to elect the principal and the chairperson of the parents council must be held at least one week before the end of each school year (5.02.1). Based on this, parent council will not violate the bylaws to conduct the voting for such illegal election as it would be the last day of this school year.
Bylaws 5.03.7 says that a voting committee shall be appointed by the PC to conduct the voting. Based on this, any voting not conducted by PC appointed voting committee is invalid and illegal.
June 20, 2011, PTA rejected 6/19 election results.
The following is a response from Mr. Li Zhu, the Chairman of Parent Council, to Mr. Shengjing Li's email on June 20 titled: “Message from Board: Graduation Ceremony/Track and Field Game/Election on June 19, 2011”. Mr. Li is currently in China due to family emergency.

1.) The board meeting which approved the new pair of candidates on Sunday (6/19/2011) violated the bylaws which requires at minimum 5 board directors without conflict of interest conduct election related any businesses.
2.) Based on HXNY current bylaws any voting must be conducted by the HXNY Parent Council. HXNY has total 918 members, the Sunday's election (6/19/2011) trampled the will and right of the majority of HXNY members.
Parent Council, on behalf of most HXNY members, condemns this illegal action, and rejects this election result.

The Board will be the only responsible body hosting the election this Sunday for HXNY, as required by the bylaw.
Per Board 6/9 Resolution, a new nomination process has been opened up for one additional pair of candidates for this year's election.
1) The nomination deadline has been extended to 9:30AM, June 12. Any school member can nominate candidates. Each candidate must be clearly designated as for which position such candidate is running. The nominated pairs should be prepared to present their plans at the open meeting on Sunday, June 12 at 9:30am in CLA 200 of WCC 2) The Board will review and approve one additional pair of candidates for School Principal and Chair of Parents Council. 3) Only the Board Approved candidates can be added onto the Ballot, any ballot with unapproved candidates’ names on it will deem to be invalid. 4) In case no one gets the simple majority votes, the board will call for the same election process next week until the School Principal and Chair of Parents Council are elected.

The 5 board members led by Shengjing Li arbitrarily changed the candidate nomination deadline three (3) time to put their hand-picked pair as the second pair of candidates, along with the first pair of their hand picked candidates, on the ballot and then claimed that they provided members with choices for a contested election.

Alan is not chosen by the Board! He was elected by 280 votes. What kind of LIARS Gary Guo, Shengjing Li, Qing ZHou, Minghui Lei is!!! I doubt why Alan didn't counter sue. Shame, shame, shame!!!
How could you let someone like Zheng Qi be the principal of a school? She didn't even hesitate using the "B" word in front of school age children. Do you honestly believe this person can qualify to be a principal? It's so unfortunate for the school that she was the dean for many years.
One question for all the candidates is whether they will follow the school bylaws (old or new) and protect its integrity as what Hu/Liu have done? Let's hear their answer and we'll know.

是啊，博主想诗情画意一下，可给楼上胡家班那文革语言一紧跟，诗意一扫光。再铁的博主，看到流氓们这么没文采，很快也会划请界线的。我可保证这位博主会变得越来越中立，最后还会反戈一击！近朱者红，近墨者黑。物以类聚，人以群分！谁会与胡骗子同道而行，哪天保不证就被他出卖了。
这博主还行。本是胡/刘之流，看了告法庭的东西，怎么也想不通。自己支持的人怎么会是这样的无赖？！于是只能来一首谁也不得罪的朦胧诗，唉。。。

Delete答： 修改校章、直选董事是经过去年混乱之后，多数家长的共识。本学年董事会与BAC本着求同存异，一致向前的诚意，一直寻求协商解决问题的途径，并在其他关心校章修改家长的支持下，多次做出让步，妥协。遗憾的是，胡大鹏/刘雅文阳奉阴违，反复无常，甚至出尔反尔，激化矛盾，至今没能协商解决问题。
* 胡/刘多次公开表示支持校章修改，暗地里却处处为难。 例如，不发董事会决议，私自修改BAC通告，不给场地。
* 胡/刘阻挠家长参与新校章初稿的修改，他们在开会时间和地点做手脚。
* 胡/刘反对新校章上反复无常，甚至出尔反尔。他们一会儿反校长、家长会长隔年选举，一会儿反conflict resolution, 一会儿反limited voting, 一会儿反董事会权利太大, 一会儿又要校长任命。 现在我们看清楚了，他们真正反对的是新校章规定的董事会全面普选。
* 董事会5月8日强调将竭力通过校内协商解决问题，化解危机，不首先动用法律手段。但胡/刘一意孤行，竟把董事义工告上法庭，激化矛盾，威胁学校的前景。
问： 在校章修改的过程中，董事会和BAC采取哪些协商的措施？
Delete答：新校章是纽约华夏建校以来，修改时间最长，家长参与最多，修改幅度最大的校章。在八个月中，BAC 广泛听取各方（包括校委会、家长会）意见建议，在坚持原则前提下，做了很多重要调整。例如：
1、在胡大鹏等人的建议下，删去现任校长、家长会长不能当年参见竞选的限制。
2、增加了董事选举limited voting每票选举董事的数量：从1位增加到5位。
3、使dispute resolution成为非强制性。
可惜，所有让步和妥协，还是无法满足胡/刘，他们期望不经选举，自动直接进入董事会。 董事会坚持了董事会、校长和会长必需经过家长全面直选的原则，结果引来了胡/刘针对董事义工的官司。
问： 胡/刘的诉状里，有哪些欺骗家长和法庭、前后矛盾之处？

什么是他们的“正当权益”呢？原来还是“自动进董事会”！在起诉四董的状词里, 胡/刘多次声称:
1）在过去的一年里，胡大鹏/刘雅文一直期盼任期满后，自动进入董事会。
2）新校章剥夺了胡大鹏/刘雅文不经选举，自动直接进入董事会的权益。
3）新校章规定的董事普选会给胡大鹏/刘雅文带来不可弥补的伤害, 因为旧校章规定胡大鹏、刘雅文无需选举，自动进入董事会。
问：胡大鹏、刘亚文做了哪些阻碍修改新校章的事？

BAC主席刚一上任，就热情邀请校委会和家长会各派一名代表加盟，希望他们推荐普通家长，不欢迎“头面人物”和“有争议人物”。不料，胡/刘先是推荐了自己，遭婉拒后，又推出两位有争议人物：林女士（曾为校长候选人、高调卷入去年风波）和高先生（非家长会成员，孩子不在校）。经过协商，董事会接受了高先生；希望换下林女士，另寻人选。校委会有十多名成员，不少是新面孔，另寻人选的余地很大。可是胡、刘拒不妥协, 干脆不推荐了，有意让董事会和BAC背上黑锅。于是，“拒绝校委会和家长会成员加入校章修改工作”谣言就出台了，被不断重复，还出现在“罢免朱董事长”的倡议书上。
真相2： 胡、刘垄断mailing list,阻碍BAC与家长直接交流。
董事会依法向胡大鹏要全校mailing list，他拒绝提供。胡大鹏的校委会控制全校资源，控制newsletter。胡/刘发布BAC工作进展内容时，未经BAC主席授权，有意裁剪或扭曲BAC讨论议题。仅举一例：2011年10月20日，胡/刘在未经BAC主席同意下,擅自修改BAC给董事会校章修订进展的报告,断章取义在校刊上发表。
特别指出：胡、刘对家长的态度就是“防”。翻开往年的全校通讯录，上面都印有家长地址。可是今年的通讯录有意隐去地址，居然连董事会名单都未刊印。二人紧抓手里之权，拒绝与全校家长分享，没有同心同德的意识，难怪新校章命运多舛。现在，二人把志愿者告上法庭，走上一条追求权力的不归路。
真相3. 多次拒绝给BAC提供开会场所。
由于胡大鹏的不合作，BAC的很多会议只好在草坪上进行。新校章的初稿完成后，BAC需要举办与家长的交流会。可是，胡大鹏推说“没有空余教室”，并散布谣言说BAC要与孩子抢教室。在热心人帮助下，BAC按时在science102召集了会议，戳破“没有空余教室”的谎言。
1、在胡大鹏等人的建议下，删去现任校长、家长会长不能当年参见竞选的限制。
Delete--这条的针对性也太明显了吧？随便剥夺成员的被选举权，BAC能自圆其说吗？呼吁删去这条的也不仅是胡大鹏吧？
2、增加了董事选举limited voting每票选举董事的数量：从1位增加到5位。

3、使dispute resolution成为非强制性。
-- 这一条从公布后大家就反对，李建仁一直不肯改。最后送律师审查时，被律师指出与州法矛盾才改为非强制性。这能说明李建仁听取了大家的意见？

星期天我到中文学校去问财务长按学校的校章，被告的自愿者学校不是应付他们的应诉费吗？李盛京董事在旁边马上接话说，那可不一定，要看他们是不是有good faith. 我说被告的董事又不是为自己，他们一直在为中文学校有一个新的开始而努力，当然是good faith了。他说我们说了不算，法庭说了才算。 看，在我们的老校长那里校章也不过是一页废纸。他还说董事长就需要做两件事，一是通过budget，二是选出校长，他都做到了。是啊他做到了，学校也乱了一年多了。

The school belongs to all members, if nobody cares about the school, and we can only accept whatever is being offered, which may not be to the best interest of parents. I don't know too much about the history and not interested to know either. I am sure there is a lot baggage there. However there are two things bother me the most in the past few months:
ReplyDeleteThe school already have a voting committee for Bylaw and the whole process is fairly transparent. Without going through any normal legal procedure, either you have to find the current voting committee is illegal and cancel it before you can set up another one, the Board Chairman set up a voting committee themselves and without any supervision. If anyone can do this in school, how chaotic it will be.
ByLaw means " By the Law". Everyone has to follow it before the new bylaw is passed. ByLaw states 5 board members need to be present to call a Board meeting. So far there have not been anytime we have more than 4 members for the board meeting and the board chairman made a lot of statement claiming that is Board's decision. As the Board chairman, he supposes to have the best knowledge about bylaw and he is the one violates it the most.
Below is an email from a parent in my son's class. It propose a temporal solution for now. Dear all members,
This is to respond to the board's Request for election on June 19, 2011.
First I didn't postpone the meeting on June 12. It was the board that delayed the meeting and due to time limit, it was impossible to finish the agenda. It was clear and nobody should try to confuse and mislead members.
It is clear in the bylaws that a meeting of member to elect the principal and the chairperson of the parents council must be held at least one week before the end of each school year (5.02.1). Based on this, parent council will not violate the bylaws to conduct the voting for such illegal election as it would be the last day of this school year.
Bylaws 5.03.7 says that a voting committee shall be appointed by the PC to conduct the voting. Based on this, any voting not conducted by PC appointed voting committee is invalid and illegal.

1.) The board meeting which approved the new pair of candidates on Sunday (6/19/2011) violated the bylaws which requires at minimum 5 board directors without conflict of interest conduct election related any businesses.
2.) Based on HXNY current bylaws any voting must be conducted by the HXNY Parent Council. HXNY has total 918 members, the Sunday's election (6/19/2011) trampled the will and right of the majority of HXNY members.
Parent Council, on behalf of most HXNY members, condemns this illegal action, and rejects this election result.

The Board will be the only responsible body hosting the election this Sunday for HXNY, as required by the bylaw.
Per Board 6/9 Resolution, a new nomination process has been opened up for one additional pair of candidates for this year's election.
1) The nomination deadline has been extended to 9:30AM, June 12. Any school member can nominate candidates. Each candidate must be clearly designated as for which position such candidate is running. The nominated pairs should be prepared to present their plans at the open meeting on Sunday, June 12 at 9:30am in CLA 200 of WCC
2) The Board will review and approve one additional pair of candidates for School Principal and Chair of Parents Council.
3) Only the Board Approved candidates can be added onto the Ballot, any ballot with unapproved candidates’ names on it will deem to be invalid.
4) In case no one gets the simple majority votes, the board will call for the same election process next week until the School Principal and Chair of Parents Council are elected.
Here is a quick note on Sunday’s election:

1. 学校的乱局不能归咎于去年董事按章行事。现有校章要遵守，对。但是，其缺陷也是存在的。去年至今，乱局是制度缺陷和一些触犯到个人利益的小团体推波助澜造成的，而不是因为去年董事照章行事。基于这些认识，所以我们要按照校章的合法的规定，去修改校章。但是，校章修改委员会（为小团体左右）没有完成任务，我们不得不继续遵守有缺陷的校章。
Delete2. 对校章的缺陷，全体会员有共识，如对候选人的遴选，和董事的产生方法。BAC没有针对性地修改，反而引进了更多的有争议的条文，如Limited Voting, 治理结构中的上下级关系，等等，会员不能接受。几位董事用非法的方式欲强行通过，才陷入法律纠纷。校章没有如期修改， 使这些缺陷依然存在。我们不得不面临选择，是按照这些条文选校长、家长会长，还是设法改进。
3. 有选择地不实行现有校章中的某一条款, 跟几位董事违反校章不属于一个性质。几位董事知法犯法，故意违反选举程序，操纵选举，违反校章。而我们的诉求，是针对有共识的校章缺陷，协商一个办法来对待，在征求会员意见之后，会以合法的方式推进。征集Petition, 是校章规定的会员的权利。在达到法定人数后，最后如何实施，也是需要全体会员通过的。
4. 现在诉求的是权宜之计，目的是应对本来交付BAC处理的候选人遴选问题。变更校章条款涉及面广，须审慎行事，所以我们诉求的不是正式修改该条款，而是针对性地暂缓实施。这种做法是有先例可循的。而且，最重要的是，这个诉求是会员权利的体现。改变候选人遴选的做法，是大多数会员的共识，也是相对独立的条款，不会牵一发而动全身，具备可操作性。
5．现有校章的另一个缺陷，董事产生办法，因涉及面太广，影响更大（董事任期长），很难用权宜之计对待。但是，我们也多次呼吁，要用合法的方式尽快产生董事直选方式。

Delete由董事会预选候选人是校章里的缺陷，这是大家的共识。不然就不会有今年的改校章。
Delete但是校章允许，董事会就可以用。后来的事实证明，5董做的没错。ZZ不适合做学校领导。搞群众运动，弹劾李董可以说是校章给的权力。但是弹劾没通过就不该再闹。后来的一系列事件使矛盾升级。是谁的责任大家都很清楚。所以今年支持小集团的人越来越少。
新校章的Limited Voting不是“普选”。如果不是为了维护帮派利益硬要塞进Limited Voting， 新校章现在已经通过并实施。
用违法，作弊的手法强行通过新校章，在客观上确实损害了胡/刘的权利。把这个事实写进状纸没错。违法，作弊是更严重的问题。避重就轻可以作为个人攻击的手段，但是发在董事会成员的声明中，是极不负责的行为。

ReplyDelete目前，学校再次上演“整人官司”，针对四位董事义工。我们呼吁“撤诉、直选、还权于家长”。本文揭示学校某些纠纷的起因，为的是捍卫家长的知情权，保护学校的财产和会员的名誉。
遭受去年动乱之苦的家长，都意识到修改旧校章是当务之急。时隔一年后，学校的乱象却越演越烈，令人痛心：1）新校章出台受阻；2）四董事被告上法庭；3）家长选举权被践踏。
新校章对校长、家长会会长选举的规定同旧校章一样，可是制造混乱的人，却想“趁乱”不经选举就自动做董事、当校长。他们以为依靠控制舆论，就可以胆大妄为。然而，真相无敌！鉴于胡/刘起诉四位董事围绕着“新校章”，我们就慢慢梳理他们几个月里的所作所为吧。
问：胡大鹏、刘亚文做了哪些阻碍修改新校章的事？
真相1： 胡、刘反对修改校章委员会（BAC）由中立家长组成。
BAC主席刚一上任，就热情邀请校委会和家长会各派一名代表加盟，希望他们推荐普通家长，不欢迎“头面人物”和“有争议人物”。不料，胡/刘先是推荐了自己，遭婉拒后，又推出两位有争议人物：林女士（曾为校长候选人、高调卷入去年风波）和高先生（非家长会成员，孩子不在校）。经过协商，董事会接受了高先生；希望换下林女士，另寻人选。校委会有十多名成员，不少是新面孔，另寻人选的余地很大。可是胡、刘拒不妥协, 干脆不推荐了，有意让董事会和BAC背上黑锅。于是，“拒绝校委会和家长会成员加入校章修改工作”谣言就出台了，被不断重复，还出现在“罢免朱董事长”的倡议书上。
真相2： 胡、刘垄断mailing list,阻碍BAC与家长直接交流。
董事会依法向胡大鹏要全校mailing list，他拒绝提供。胡大鹏的校委会控制全校资源，控制newsletter。胡/刘发布BAC工作进展内容时，未经BAC主席授权，有意裁剪或扭曲BAC讨论议题。仅举一例：2011年10月20日，胡/刘在未经BAC主席同意下,擅自修改BAC给董事会校章修订进展的报告,断章取义在校刊上发表。
特别指出：胡、刘对家长的态度就是“防”。翻开往年的全校通讯录，上面都印有家长地址。可是今年的通讯录有意隐去地址，居然连董事会名单都未刊印。二人紧抓手里之权，拒绝与全校家长分享，没有同心同德的意识，难怪新校章命运多舛。现在，二人把志愿者告上法庭，走上一条追求权力的不归路。
真相3. 多次拒绝给BAC提供开会场所。
由于胡大鹏的不合作，BAC的很多会议只好在草坪上进行。新校章的初稿完成后，BAC需要举办与家长的交流会。可是，胡大鹏推说“没有空余教室”，并散布谣言说BAC要与孩子抢教室。在热心人帮助下，BAC按时在science102召集了会议，戳破“没有空余教室”的谎言。
问： 在校章修改的过程中，董事会和BAC采取哪些协商的措施？
答：新校章是纽约华夏建校以来，修改时间最长，家长参与最多，修改幅度最大的校章。在八个月中，BAC 广泛听取各方（包括校委会、家长会）意见建议，在坚持原则前提下，做了很多重要调整。例如：
1、在胡大鹏等人的建议下，删去现任校长、家长会长不能当年参见竞选的限制。
2、增加了董事选举limited voting每票选举董事的数量：从1位增加到5位。
3、使dispute resolution成为非强制性。
可惜，所有让步和妥协，还是无法满足胡/刘，他们期望不经选举，自动直接进入董事会。 董事会坚持了董事会、校长和会长必需经过家长全面直选的原则，结果引来了胡/刘针对董事义工的官司。
问：胡大鹏和刘亚文积极配合新校章的投票工作了吗？
没有，相反一再设置障碍。3月25日新校章提案得到了董事会的全体通过，意味着其内容已大致确定，下一步就是寻求全校公投了。校委会和家长会理应全力以赴，组织好投票工作。可是，胡/刘继续设障，要求把318教改投票的结果放进新校章，除了保留直选，提议去掉其它所有条目。新校章草案的每一条内容都经过了八个月的讨论，而且动一发牵全身, 怎能在临近投票的最后关头，说改就改呢？于是，他们消极应付投票的筹备工作，一拖再拖，直到4月10日还没有邮寄出选票。
1、在胡大鹏等人的建议下，删去现任校长、家长会长不能当年参见竞选的限制。
Delete--这条的针对性也太明显了吧？随便剥夺成员的被选举权，BAC能自圆其说吗？呼吁删去这条的也不仅是胡大鹏吧？
2、增加了董事选举limited voting每票选举董事的数量：从1位增加到5位。
-- 1位改成5位没有改变实质，仍然是Limited Voting。仍然是限制家长们的选举权利。仍然是为了维护小帮派利益。
3、使dispute resolution成为非强制性。
-- 这一条从公布后大家就反对，李建仁一直不肯改。最后送律师审查时，被律师指出与州法矛盾才改为非强制性。这能说明李建仁听取了大家的意见？
2、增加了董事选举limited voting每票选举董事的数量：从1位增加到5位。
Delete当初谁提出只选一位的？提出这种选法本身就是反对民主。
羞羞答答不情不愿地不得已变成5位，也不过是个半吊子改良。为什么不能变得彻底些？

是真的，但是周、李、雷三位董事对此要负主要责任！校章规定“五位以上董事认可，才能通过董事会决议。”于是，董事会开会时，他们三位耍滑头，总是无故缺席，造成董事会工作上的困难。不过董事会咨询了律师，在紧急关头，董事会的多数也可以形成决议。所以，面对乱象，四位董事毅然承担起责任，以全校家长和学生的利益为重，努力推进着合理的《董事会决议》出台。
问： 胡/刘的诉状里，有哪些欺骗家长和法庭、前后矛盾之处？
去年，胡大鹏和刘雅文的竞选宣言是：“当选不是为进董事会”，“支持废除校长家长会长自动进入董事会的制度”。今年，他们告诉家长起诉董事“不是为了我们自己自动进董事会”，同时称要通过法律手段捍卫“我们的正当权益。”
什么是他们的“正当权益”呢？原来还是“自动进董事会”！在起诉四董的状词里, 胡/刘多次声称:
1）在过去的一年里，胡大鹏/刘雅文一直期盼任期满后，自动进入董事会。
2）新校章剥夺了胡大鹏/刘雅文不经选举，自动直接进入董事会的权益。
3）新校章规定的董事普选会给胡大鹏/刘雅文带来不可弥补的伤害, 因为旧校章规定胡大鹏、刘雅文无需选举，自动进入董事会。
问： 为什么没能通过协商和调解，来解决问题？
答： 修改校章、直选董事是经过去年混乱之后，多数家长的共识。本学年董事会与BAC本着求同存异，一致向前的诚意，一直寻求协商解决问题的途径，并在其他关心校章修改家长的支持下，多次做出让步，妥协。遗憾的是，胡大鹏/刘雅文阳奉阴违，反复无常，甚至出尔反尔，激化矛盾，至今没能协商解决问题。
* 胡/刘多次公开表示支持校章修改，暗地里却处处为难。 例如，不发董事会决议，私自修改BAC通告，不给场地。
* 胡/刘阻挠家长参与新校章初稿的修改，他们在开会时间和地点做手脚。
* 胡/刘反对新校章上反复无常，甚至出尔反尔。他们一会儿反校长、家长会长隔年选举，一会儿反conflict resolution, 一会儿反limited voting, 一会儿反董事会权利太大, 一会儿又要校长任命。 现在我们看清楚了，他们真正反对的是新校章规定的董事会全面普选。
* 董事会5月8日强调将竭力通过校内协商解决问题，化解危机，不首先动用法律手段。但胡/刘一意孤行，竟把董事义工告上法庭，激化矛盾，威胁学校的前景。
问：应该怎样解决目前的争执？
答： 中文学校人心思定，我们反对在一年之内，把法律诉讼再度引入学校。本学年不到一个月就结束了，我们担心下学期孩子们的上学问题。现在纠纷既然进入法律程序，我们认为应尽快通过法律程序，解决纠纷, 找出长期解决方案。
我们想借此机会指出，学校资产属于华夏纽约中文学校，不是某人或某个小团体的私有财产。现任校委会，家长会在任期满后，必须如数全部交还学校。

有一部电影叫《〈步步惊心〉》，电影没看过，名字记住了。我们中文学校也正在上演这样的戏。每一次我都会想下一步有什么。每一次都是最坏的情况在发生。这百分之百的命中率，要是彩票就好了。在被文革了大半年了以后，5/15的时光列车一下把我们带回到了国民党白色恐怖时代，那一个心凉啊。
星期天我到中文学校去问财务长按学校的校章，被告的自愿者学校不是应付他们的应诉费吗？李盛京董事在旁边马上接话说，那可不一定，要看他们是不是有good faith. 我说被告的董事又不是为自己，他们一直在为中文学校有一个新的开始而努力，当然是good faith了。他说我们说了不算，法庭说了才算。 看，在我们的老校长那里校章也不过是一页废纸。他还说董事长就需要做两件事，一是通过budget，二是选出校长，他都做到了。是啊他做到了，学校也乱了一年多了。
回到5/22 的“问答”。这次我们从后往前说。
“Q5Q6”：董事会为什么会成立SVC，采用公开投票和邮寄方式，大家可以查询3月，4月学校的newsletter 和董事会发布的消息而找到第一手资料。我想说的是Hu/Liu本人就是上届董事会以SVC的方式选出来的。而邮寄投票是我们胡校长/刘家长会长亲自首创的。他们做的时候就是堂堂正正，干干净净。别人做的时候就是违法和不干不净了。这要需要多大的自信和骄傲才能完成这唯我独尊的逻辑。
“Q4”：我把bylaw里Indemnification 条款拷贝在这里。大家自己看我们将来是不是必须得买这个单。这个单也是告人者迫使我们付的。Hu/liu告人这是他们的自由，但是他们凭什么用中文学校的名义告自愿者。如果说中文学校是我们家长大家的，他们告人问过我们吗？董事会是中文学校的法人，这上法庭的事他们通过董事会了吗？如果这是在他们律师的咨询下的做法，那么这种“法人在法人不知道的情况下把法人自己告了”的悖论，会在华人社区永垂不朽的。要是以中文学校的名义，那么是不是中文学校现在或将来必须得给他们付告人费呢？我相信财务长不会同意给他们付这个钱的，不过保险起见，下次上课我还是要去问问。

“Q2”：这是最让我生气的一条。我们被文革了大半年，现在又被带入了白色恐怖之中。还来告诉我们是为了学校为了我们。收起来吧，校规也不过是对别人，不对他们自己。星期天在停车场，有一个家长拉住我说了半天。她说她已经有一个月没来中文学校了，她心脏不好，不想来添堵。她说大家都是朋友，孩子一起长大的人现在因为这些事都不说话了。这就是中文学校的现状。我现在和别人说话也是小心翼翼，多年的老朋友也不敢联系提及这些事，怕大家意见不一样，反而作不了朋友了。这么压抑的环境怪不得这么多人在考虑离开。运动他们搞，法庭他们上，还说要维持学校的良好风气，真是苍天有眼。
“Q1”：BAC完全由一般中立家长组成，他们中有大学教授，很多是有法律专业背景的。可是也许正因为如此，他们修改bylaw的旅程走得特别的难。大家可以到http://groups.yahoo.com/group/HXNYBylawsCom/links 上去看看，有多少对BAC成员的攻击，有些还是学校领导针对他们人格的而不是他们修改的bylaw。也许大家都还记得在开学之初，他们为了自己进入BAC展开的运动，还有后来他们在学校的newsletter上连续几周对新bylaw随意的歪曲，误导和用捏造的事实对新bylaw进行抨击。我一直不理解为什么他们一定要这样对新bylaw进行围攻堵截，有时根本不是因为什么条款有问题，我原以为他们是为了自己的主张得到承认而为之的。可是要是大家都是为了中文学校好，为什么要大打出手呢？现在看来不全是。去年他们花了钱上了法庭，在中间家长的努力下谈和，大家带着善良的愿望，希望把bylaw改好，从新开始。可是因为BAC没有包括他们的人，他们好不容易花了钱得到的主动权被人拿走，那还不急疯了。这也是人之常情，不难理解。有的时候真相就在一些简单的道理里面。他们所谓的协商，也就是不要新bylaw通过，要在他们的领导下在下面一年里进行改写。
今年他们又再次把自愿者告上了法庭，从他们自己的钱包里出来的钱将会更多。去年他们快速地撤诉，并没有等到法庭做出公正的裁决。可是今年难办了，撤诉意味着新bylaw的通过，不撤意味着花的钱将比去年多。那么心理的不平衡将会更大，那么将来我们，我们中的自愿者将更没有安全。以后只有这几种人在中文学校有安全：
1． 有几十万没地方用的钱，不怕他们告的人；
2． 为他们告自愿者捐款的人；
3． 现在或将来都不会和他们有意见不同的人。
周英，同样的东西来回贴有意思吗？让你问问朱立4/15SVC的投票有没有作弊你怎么不问？当天收到多少票？4/15以后收到多少邮寄票？

ReplyDelete华夏学校从去年闹到现在又回到法律诉讼上, 一年内美国总统都可以选完了, 我们联个校规都没有完成, 花了不少学校的午饭钱不说, 什么问题也没有解决. 去年胡大鹏的校长选举合不合法不说, 他表示一定以学校的利益为重, 凭心说, 他们学校工作干的还不错, 但是今年又来了个恶人先告状,又把学校带入危机. 一年完不成, 说明你们所有的人能力都有问题, 都没有以学校和学生的利益为重, 全他妈的该辞职. 那几个脸皮特厚, 特无廉耻感的李盛京, 周箐,雷明辉等就是学校动乱的根源. 在本职工作中找不到快感和高潮, 跑到中文学校来来捣乱,耍点淫威, 口口声声说辞, 到现在也没辞职. 我XXXX!
