来华夏短短数年俺就亲身经历了几次危急关头。HUANG女士和LIN女士竞争校长那年，俺收到伊妹儿称学校到了生死存亡关键时刻，如果选LIN女士学校就要嗝屁所以一定要选HUANG女士。
去年又被搞到危急关头，弹劾再弹劾最后升级到法庭，整出一堆JONE DOES。第一次危急感觉是玩过家家互相树个敌人，去年斗争升级帮派成立，真枪实战玩真格儿了。
今年还是有HUANG女士和LIN女士。校方舆论好象是这次如果HUANG女士帮得逞学校就危急了。星星还是那个星星，月亮还是那个月亮，人还是那些人。双方干着合法非法的事，就是让对方不舒服。
HUANG女士帮的ZHU董事长被自己人称作英雄好汉，被LIN女士帮定为史上最差的董事长，不被弹劾除掉不痛快。不知是不是积累去年的斗争经验，今年弹劾一拖再拖，哈哈让ZHU董想找几个JOHN DOES都确定不了日期。
好在俺期望的学校开学得以实现，炎炎夏日危急关头俺就不掺和了。

问题是不把朱立弹劾出董事会，明年改Bylaws还得乱。我不同意博主“双方干着合法非法的事”，守法是底线。不管怎么看对方不顺眼也不能干违法的事。如果朱立不干违法投票的事，胡/刘也不会告4董上法庭。上法庭不是为了继续旧Bylaws，而是保卫家长们对修改Bylaws的发言权。4/15投票结果，不能让4董用非法的手段践踏。

On June 21, 2012, Dapeng Hu and Yawen Liu, through their attorney, filed a legal motion (click for the original court paper) to the Supreme Court of the State of New York, Westchester County, seeking to overturn the Temporary Restraining Order (TRO) issued against them on June 8 and to invalidate the Principal and PC Chair election held on June 17 pursuant to the 2010 Bylaws and the June 8 Court Order.
Today, the judge issued a temporary ruling by refusing to grant Principal Hu and PC Chair Liu’s request to overturn the June 8 TRO and denying their request to invalidate the legitimate June 17 election and its election results.

朱立是HXNY有史以来最差的董事长。
ReplyDelete朱立做事毫无原则，一切以帮派利益为准。去年5董否决ZZ，他攻击5董曲解Bylaws，用给家长选择权的口号煽动搞群众运动，破坏选举。今年他当董事长，就换了一副嘴脸。坚持使用董事会否决权。去年5董只认为ZZ不适合做候选人，并不反对别人参加竞选。今年朱家帮推出两队候选人，利用Bylaws里“not more than two pairs"的条款，众目睽睽之下公然预谋封杀任何不属于朱家帮的候选人。
朱立视校产为私产，任意挥霍。去年5董为了阻止朱家帮非法干涉选举的行为走上法庭，他们完全有理由也有权力用学校的钱支付法律费用。但是他们没有这么做，而是自己负担了律师费。今年朱立造假作弊破坏4/15 Bylaws投票，害怕受到法律惩罚，抢先伪造董事会决议，授权给自己用学校的钱打官司。5/16 TRO出来以后，朱立于5/20找到财务长要5万美元，遭到拒绝。6/8又上法庭告胡/刘和3董，同时要求法官允许他从学校拿5万美元。3月份BAC要把修改的校章送给律师做最后修改，朱立不顾校章里仍有很多有争议的条款，随便批给李建仁一万律师费，导致这一万元完全浪费。
朱立首开HXNY献金政治的先例。4董批准出线参选的两队候选人都给4董的法律诉讼基金捐巨款。而被大家看好，没捐款的一队却被封杀。面对家长的质问，朱立等4董至今不敢对他们是否接受候选人捐款作出正面回答。
朱立当董事长唯我独尊，拒绝听取任何不同意见。过去的历届董事长虽然都非民选，但他们至少还能听取家长们的意见。只有朱立，对不同意见一概拒绝。甚至对投票结果，都可以不理不睬，当作不存在。3/18教改投票表达了绝大多数家长支持教改的愿望，朱立对此装聋作哑，没有任何表示，最后甚至在法庭上绝口不提3/18投票，禁止校长按3/18投票结果进行下学期开学预注册的工作。4/15校章投票，朱立假装没看见投委会300人的合法投票结果，却拿着他自己伪造的投票结果大作文章。这个伪造的结果连他自己都知道站不住脚，在法庭文件里承认是不可靠的。
朱立滥用董事长权力，史无前例地把人身攻击的语言用到董事会文件里。董事会文件应该是严肃的，没有大量取证调查作依据，董事会或者董事长无权随意指责任何学校成员。而朱立却在董事会文件中用”谎言和恐吓“，”肮脏的政治手段“等语言攻击校长，董事会文件写得像go-hxny里的匿名谩骂。还把此类语言写入法庭文件中。这次对候选人的评论，也是毫无事实根据的指控。或许朱立在go-hxny搞匿名攻击习惯了，不觉得这样说有什么问题。但是作为董事长把这种语言引入董事会文件中，在HXNY历史上还是第一次。
7/8弹劾朱立是校章赋予家长们的权利。如果让朱立继续呆在董事会里，学校下学期还得继续乱。只有把他请出董事会，才能保证下学期校方能够切实执行3/18教改方案，保证下学期修改校章的工作能顺利进行，让学校走上安定团结的道路。
朱立是华夏史上最难做也是最有勇气的董事长。 Salute you, Zhu Li. 他的人格和人品都远在你们这些攻击他的人之上。 无论你们说什么，都无法改变他远比你们高尚的事实。 却只会让人们更看不起你们。

DeleteZhu Li and Li Jianren bear the main responsibility for the chaos. When Zhu Li is impeached, Hu/Liu go into the Board, and Li Jianren no longer the BAC Chairman, the Bylaws amendment would have a fair chance to succeed. Hu/Liu did good job as Principal/PC Chair. Their education reform benefited many parents. I believe they will be good board members next year and lead the Bylaws amendment in the right direction.

We were in the school last year. Hu/Liu's action is very shameful. The Board postponed the deadline for Hu/Liu while the pair had 285 parents votes the Board didn't allow them to participate the election. The reason parents resist Hu/Liu because their existence is illegal from the first minute. The Board only gave us one pair last year. Because of parents' strong protest, the Board allowed Hu/Liu in but eliminate the pair most popular and capable. The Board made up lies and orgnized personal attacks to long-time volunteers of HXNY. It is totally injustice.
This Board is different. They selected 2 pairs out of 4 based on their sound judgement and let us pick the best pair. I think Yang Dai/Leo Cao are truly the best candidates out of all and they deserve to be elected. Any reasonable and sensible parents will wish them the best of luck and unite under then to move HXNY forward for our children!!!
Last year, the board did call other candidates to come forward. Hu/Liu were the ones responded to the call.

If you think Dai Yang has any more legitimacy than Hu/Liu, let me just point out Dai only got 14 votes more than Hu/Liu. Dai Yang was well known a strong member of your faction. Over the last year, he always toed closely the faction line and never demonstrated any capacity to compromise or at least understand the views of other people. Dai Yang's financial contribution definitely also played a role in being selected by the 4 board members. It smells like bribery. Yet you call for peace and quiet for Dai Yang while never stop attacking Hu/Liu. How much double standard the HXNY parents could tolerate?

On June 14, certain people associated with the school PTA announced that 185 members had signed a petition to impeach and remove me from the position of Chairman of the Board of Directors of HXNY. Although I have not seen the signed petition after many requests, and I am not convinced of its legitimacy, I wish to believe that parents signed that petition out of their strong personal beliefs and not out of animosity toward me. I respect their opinions and their rights bestowed by the 2010 school Bylaws. Many parents are not happy with the current chaotic condition of our school, neither am I. I have a strong belief on who are mostly responsible for this chaos, and I hope you will believe me when I say that I have only tried to do what is best for the school.
Some of the accusations in the petition are so ludicrous that I won’t even dignify with a response such as my request for reimbursement of the legal expenses that I was forced to incur to defend myself against the lawsuit brought by Principal Hu and PC Chair Liu. This right to reimbursement of legal fees is explicitly allowed by the Bylaws. In the meantime, I’d like to point out a few simple facts for you to consider:
(1) One of the alleged reasons for my removal is that I, along with 3 other Board members, approved 2 pairs of candidates for this year’s principal election even though there were 3½ pairs nominated. I did this entirely following the 2010 Bylaw which is currently in effect. My accusers were the supporters of last year’s Board, when it disregarded the spirit of the Bylaws and designated only one pair of candidates and stripped all members their rights to choose. Today, the same group of people is accusing me for following the Bylaws. Are these the type of people you can trust to support? Don’t forget this year some board members approved only 1 ½ pairs of candidates.
(2) I have been outspoken with my support for the new Bylaws which is stuck in court thanks to Hu/Liu’s lawsuit. The one aspect of the new Bylaws that I like the most is its provision to allow members to vote for Board members, principals and PC Chairs freely. Because of the lawsuit, I was required by the existing Bylaws to choose no more than 2 pairs of candidates which I did with my best judgment. The one principal candidate I didn’t choose happens to be a professor, which is by definition more qualified according to my accusers. Since when does anybody believe that an educator is necessarily more qualified than any other professionals to be the principal at HXNY? These petitioners surely did not question Minghui Lei or Dapeng Hu’s qualifications for principal last year despite the fact that neither had any experience in education. My guiding principle for this selection is which candidates are willing and able to do the right thing and lead the school out of the current crisis. I sincerely believe that principal-elect, Yang Dai, will do a fine job leading the school down the right path.
(3) I was accused of acting against the education reform which is ludicrous. As those of you who have read my communications during the past few months can recall, I have never said or done anything against the education reform. Actually I participated, along with other board members, several reform discussions. I was, however, against Hu’s effort to legislate textbooks via a referendum. I repeatedly urged the Admin team to take a polling of the member base to hear their opinion on the textbook preference to no avail. Is it a crime against the school to speak up against requiring the usage of specific textbooks in its Bylaws?

The fact was that the Board was forced to form a SVC because of Yawen Liu’s refusal to follow the Board’s instruction and send the mail-in ballots citing lack of time and Dapeng Hu’s refusal to postpone the voting date. Last year, the school used a SVC to elect Hu and Liu into their current positions that neither of my accusers voiced any disagreement. Is there any doubt in your mind that I acted in good faith approving the SVC in order to maximize the participation of the Bylaws vote?
The unfortunate dispute has entered legal proceedings initiated by the current Principal and PTA Chair. I am looking forward to the day when we can all hear from an impartial judge as to who have been acting in bad faith and damaging the school. We will hopefully resolve the disputes once for all. In the meantime, however, the Court has ordered that the "status quo" must be maintained, which means that the proposed vote to impeach me is improper while the lawsuit is still pending.
Dear parents, our school is at a critical junction. I am very grateful for the unwavering support from many parents and teachers. Your support and solace have warmed my heart and strengthened my resolve. I hope to count on your continued support during this trying time of our school. From the complaints provided to the court, I do not believe the statement of "It's an unmistakable fact that Hu/Liu went to court to defend the legitimate 4/15 Bylaws voting result." at all!
DeleteI believe that the 2 groups who filed lawsuits against each other both have their own arguments, with merit or not, strong or not. Nobody can, should, claim that his own group is doing the God's job!!!
To me, each of the 2 groups is making the chaos escalating! Maybe not 50/50, but absolutely nobody is 100% right or wrong here!
That is why both groups should be held responsible for the whole drama that makes the members losing trust!
The best solution now might be both groups, meaning all the current board, admin, and PTA RESIGN at once!
I agree that both sides need to take responsibility of the current unacceptable status of our school. They should all resign. Let parents directly elect all board members without any pre-screen.

Dear HXNY Members,
The school board had a tele-conference on Friday, July 8th, 2011.
The following motion was proposed at the tele-conference:
Due to the resignation of Alan Wang, according to Bay-Law 7.01.4, one Vice Principal shall be appointed by the Board of Directors as the Principal for the rest of the term. This VP will be a new board member and will join the rest of the group in the coming year.
Board of directors continued the discussion after the board meeting. Qing Zhou and Ying Huang modified the motion as follows:
1) Pursuant Bylaws 7.01.4, the Board approves Lida He as the interim Principal leading the 2010-2011 Admin team's transition effort to the 2011-2012 ADMIN team as approved by the Board on 07/08. Lida's term ends on 07/31/2011 at the latest.
2) As retiring interim Principal, Lida will join the 2011-2012 Board when it meets for the new school year. Lida's term will end upon new election as defined by the Bylaws at the time. The other board members will follow the regular transition rules as defined by the Bylaws at the time.
3) A transition party among teams will be organized on or around July 31st.
Four members voted "yes" to the motion officially and the other members approved the motion orally. This motion is also reflected in the legal settlement agreement. Therefore, the Sue/Qing motion has officially passed.

On June 21, 2012, Dapeng Hu and Yawen Liu, through their attorney, filed a legal motion (click for the original court paper) to the Supreme Court of the State of New York, Westchester County, seeking to overturn the Temporary Restraining Order (TRO) issued against them on June 8 and to invalidate the Principal and PC Chair election held on June 17 pursuant to the 2010 Bylaws and the June 8 Court Order.
Today, the judge issued a temporary ruling by refusing to grant Principal Hu and PC Chair Liu’s request to overturn the June 8 TRO and denying their request to invalidate the legitimate June 17 election and its election results.
